Description
The brave new world of a constitutional right to family life is now with us, since the implementation of the Human Rights Act. This book assesses the impact of the Human Rights Act on family law and explores the changes Article 8 (the right to respect for family life) will make to related areas of law. The book includes a detailed analysis of Articles 6, 8 and 14 and their impact on practice and procedure in cases that involve family life - including pensions, ancillary relief, public and private law children's cases, adoption, cohabitation, same gender relationships, domestic violence, immigration, education, employment, juveniles and minors. The book includes summaries of cases and an explanation of the remedies available for breaches of convention rights including judical review and damages.
